1. Definitions
For the purposes of these General Terms and Conditions of Sale, the following definitions apply:
• Client: any professional in the real estate market and, more generally, any natural or legal person using the services of Imocomunidades.
• Imocomunidades: the company Imoedit sàrl, with its registered office at L-3509 Dudelange, 14, rue de Lentz, registered in the Luxembourg Commercial Register under number B287430.
• Medium: the non-material medium (publications in electronic form) through which a communication or set of information is disseminated. These include: Imocomunidades and any other products to be developed in the future.
2. Scope of Application
2.1
These General Terms and Conditions of Sale (hereinafter referred to as “GTCS”) apply to all transactions between Imocomunidades and the Client in the context of subscriptions and sale of advertising space on Imocomunidades. Imocomunidades reserves the right to modify the GTCS freely and at any time. Each Client is invited to regularly consult the GTCS, available at:

New GTCS will be brought to the Client’s attention through online modification and notified by email.
2.2
In the event of any discrepancies or contradictions between these GTCS and those of the Client, these GTCS shall prevail.
3. Formation of Contract
3.1
Any subscription by a Client to Imocomunidades services or to a subscription listed in §6 of these GTCS constitutes full and complete acceptance of the GTCS in force.
3.2
By transmitting the data of an advertisement or service, the Client gives Imocomunidades consent to enter into a contract and make the content of their advertisements available in the database for a limited period, for publication on one or more media. The contract is concluded upon the Client’s acceptance of the proposal.
4. Services and Obligations of Imocomunidades
4.1
Imocomunidades reserves the right to monitor advertisements submitted by the Client for publication. If Imocomunidades becomes aware of content that does not comply with applicable legislation or these GTCS, it has the right to delete, in whole or in part, the content of the advertisement or block access to it, without prior notice to the Client and without the possibility of obtaining any compensation or reimbursement.
4.2
If the advertisement has been published electronically, the Client may deactivate it at any time. Any substantial modification of the advertisement after publication shall be considered a new publication and must therefore be paid for by the Client in accordance with the rates in force.
4.3
Imocomunidades is not obliged to retain a published advertisement after the end of its publication period.
4.4
Imocomunidades reserves the right to modify its services, provided that such modifications do not alter the nature of the contract and taking into account the interests of the Client.
4.5
Clients have the option of importing data for a large number of advertisements on the Imocomunidades online platform. This data is processed and transformed by Imocomunidades into the format required for publication. When formatting, only the structure of the data is adapted, not the content.
5. Client Obligations
5.1
The Client is solely responsible for the content of the advertisement and its complete transmission within the required timeframe (at least 5 working days before the intended publication date). The Client guarantees that the content complies with applicable legislation, that they hold the intellectual property rights over that content and that it does not infringe the rights of third parties. The Client indemnifies Imocomunidades against all financial consequences of actions, claims or oppositions arising from the breach of these warranties.
5.2
Transmission of advertisements on behalf of third parties is not permitted without their express consent. In particular, third-party telephone numbers or addresses may not be published without their authorisation.
5.3
The Client undertakes to verify the advertisement as soon as it is published and to inform Imocomunidades of any problems or errors within seven (7) days of publication. After this period, any subsequent complaints will not be taken into consideration.
6. Membership Plans and Subscriptions
Imocomunidades offers two types of subscriptions, depending on the Client’s profile:
6.1 Plans for Real Estate Agencies
The offers for real estate agencies are as follows:
Essential — €59/month (or €590/year): unlimited property listings, basic profile on the platform, visibility to non-resident audiences, access to the Imocomunidades ecosystem.
Professional — €99/month (or €990/year): everything in Essential, plus certified partner page, publication of own content on the platform, monthly boost on Imocomunidades social media, participation in the “Casas às Quintas” podcast and greater commercial activation with the diaspora.
Partner — €165/month (or €1,650/year): everything in Professional, plus monthly co-signed article on the platform, regular podcast participation with greater frequency, weekly social media boost, “Imocomunidades Selection” banner on profile and homepage, “Certified Partner” seal, priority access to leads by geographic area, monthly visibility and audience origin report, presence at Imocomunidades in-person events and profile in rotation on the platform homepage.
6.2 Plans for Other Services
For professionals accompanying non-resident clients (lawyers, credit intermediaries, architects, property managers, etc.):
Member — €39/month (or €390/year): profile on the platform, publication of own content and services, visibility to non-resident audiences and access to the Imocomunidades ecosystem.
Partner — €69/month (or €690/year): everything in Member, plus certified partner page, monthly boost on Imocomunidades social media, participation in the “Casas às Quintas” podcast and greater commercial activation with the diaspora.
Ambassador — €99/month (or €990/year): everything in Partner, plus monthly co-signed article on the platform, regular podcast participation with greater frequency, weekly social media boost, “Certified Ambassador” seal, priority access to qualified contacts by area, monthly visibility and audience origin report, presence at Imocomunidades in-person events and profile in rotation on the platform homepage.
6.3 General Subscription Conditions
The prices indicated above are valid for 2026. Imocomunidades reserves the right to adjust offers and rates at any time, as well as to propose one-off promotional offers. Promotional rates apply only to the first subscription.
Individual plans are valid for independent agencies or networks of up to 5 units. For groups with more than 5 agencies, network partnership conditions with dedicated pricing are available — contact us.
Annual billing includes a two-month discount. Prices indicated are indicative, with final conditions to be defined in a meeting.
Subscription duration: 12-month period, tacitly renewable, unless notice of termination is given under the conditions set out in Article 9.

7. Publications
7.1
Unless expressly agreed in writing with the Client, Imocomunidades will integrate the Publication, at its best convenience, in the Medium(s) chosen by the Client. Placement positions cannot be guaranteed under any circumstances.
7.2
Imocomunidades reserves the right to monitor Publications submitted by the Client for Distribution.
7.2.1
If Imocomunidades becomes aware of content that does not comply with applicable legislation, regulations or these GTCS, it has the right to delete, in whole or in part, the content of the publication or block access to it, without prior notice to the Client and without any right to compensation.
7.2.2
Imocomunidades has the right to refuse, suspend or cancel a Publication without having to provide the Client with reasons, notably in the event of non-compliance with the editorial policy of the chosen Medium. In this case, the Client shall not be entitled to any compensation.
7.2.3
Imocomunidades reserves the right to modify its services at any time, provided that such modifications do not alter the nature of the contract and taking into account the interests of the Client.
8. Prices and Invoicing
8.1
All prices invoiced to the Client are those in force on the day the order is placed or the Contract is renewed, net of any applicable discounts or rebates. Promotional subscription rates apply only to the first subscription. Imocomunidades reserves the right to modify its rates at any time.
8.2
Invoices must be paid within thirty (30) days of the invoice date. Imocomunidades reserves the right to require a deposit or full advance payment in the following cases:
New Client of Imocomunidades;
Client for whom Imocomunidades has noted payment incidents or delays;
Client whose solvency appears uncertain.
Advance payment means that Imocomunidades must be in possession of the Client’s funds at least five (5) working days before the first publication or the start of the subscription.
8.3
In accordance with the Law of 18 April 2004, invoices not paid by the due date shall accrue interest at the ECB key rate, plus 8%, without any prior notice or formal notice being required.
8.4
Imocomunidades has the right to suspend its services, without prior notice and without compensation to the Client, in the event of non-payment or late payment. In this case, all outstanding amounts become immediately payable.
8.5
The Client does not have the right to make deductions or set-offs against invoices.
8.6
Any dispute relating to invoiced amounts must be sent to Imocomunidades by registered letter within one (1) month of the invoice date. After this period, the Client shall be deemed to have accepted the invoiced amount.
9. Termination of Contract
9.1
With the exception of the free subscription, subscription contracts are tacitly renewed for an equal period, unless the Client has requested termination of their contract at least two (2) months before its expiry, by registered letter to the following address:

9.2
In the event of non-payment in full of an invoice by the due date, Imocomunidades shall have the option to terminate the subscription by operation of law, without prejudice to its right to claim payment of the amount due for the commitment period.
10. Personal Data Processing
The Client, or any natural person working for them, is informed that their personal data is processed by Imocomunidades in order to fulfil its legal and/or contractual obligations, in particular for the purposes of negotiating, concluding and executing the contract, order management, invoice tracking and customer relationship management.
Data processed includes: surname, first name, professional postal address, telephone number, email address and financial information. Any changes must be notified to Imocomunidades as soon as possible.
Without the consent of the persons concerned, Imocomunidades undertakes not to transfer data to third parties, except in the case of subcontracting or legal obligation. Data will be retained for the time necessary, taking into account applicable statutory limitation periods.

11. Limitation of Liability
11.1
In the current state of technology, it is not possible to exclude all uncertainties related to the Internet. For this reason, Imocomunidades gives no warranty regarding technical defects, in particular the constant and uninterrupted availability of the portal www.imocomunidades.com and its content.
11.2
Imocomunidades shall not be liable for any direct, indirect, material or consequential damages, including loss of data, loss of use or other intangible losses, resulting from access to or inability to access the Services. In general, Imocomunidades can only be held liable upon demonstration of a culpable breach of its obligations, with compensation limited to the value of the subscription.
12. Force Majeure
Imocomunidades shall not be liable to the Client for delays or impediments in the performance of an obligation attributable to the occurrence of a force majeure event, as generally recognised by case law. The following are considered force majeure events, by way of example: total or partial strikes, floods, explosions, fires, operational accidents, wars, attacks, riots, natural disasters, disruptions to communication networks, in particular the Internet.
13. Miscellaneous
13.1
If any provision of these GTCS is declared null or unenforceable, it shall be deemed unwritten and the remaining provisions shall remain in full force and effect.
13.2
The failure of Imocomunidades to invoke, at any given time, any of the clauses of the GTCS shall not be interpreted as a waiver of the right to invoke that clause at a later date.
13.3
Imocomunidades reserves the right to modify these GTCS at any time with at least two weeks’ notice, by publishing the amended GTCS with the effective date at: imocomunidades.imoedit.lu
14. Applicable Law and Jurisdiction
These GTCS are subject to Luxembourg law. The parties agree to make every effort to resolve amicably any dispute that may arise from the interpretation, execution and/or termination of these GTCS. Failing that, such dispute shall be subject to the exclusive jurisdiction of the competent Luxembourg courts.
